    • by post: BAD BEAUTY sp. z o.o., ul. Św. Jerzego 1A, 50-518 Wrocław, Poland.
  3. These Terms and Conditions set out the rules for using the Store, placing and fulfilling orders, payments, delivery, withdrawal from the contract and complaints.
  4. These Terms and Conditions are made available free of charge in a way that allows them to be obtained, reproduced and stored.

§ 2. Definitions

  1. Customer — a natural person, legal person or organisational unit placing an order in the Store.
  2. Consumer — a natural person making a purchase that is not directly connected with their business or professional activity.
  3. Entrepreneur entitled to consumer rights — a natural person entering into a contract directly connected with their business activity where the contract indicates that it is not of a professional nature for that person.
  4. Product — a movable item offered in the Store.
  5. Contract — a distance sales contract for a Product entered into between the Customer and the Seller.
  6. Business Day — Monday to Friday, excluding public holidays in Poland.

§ 3. Technical Requirements and Rules for Using the Store

  1. To use the Store, you need a device with internet access, an up-to-date web browser and an active email address.
  2. The Customer should use the Store in accordance with the law, good practice and these Terms and Conditions, and must not provide unlawful content.
  3. Creating an account is not required to place an order. If the Customer creates an account, they should protect their login details and must not share them with third parties.

§ 4. Products, Prices and Pre-Purchase Information

  1. Information about Products displayed in the Store constitutes an invitation to enter into a contract and not an offer within the meaning of the Polish Civil Code.
  2. Prices are stated in Polish zloty (PLN) and are gross prices, including taxes required by law. Delivery costs are shown separately before the order is placed.
  3. If a price reduction is announced, the Store also states the lowest Product price applicable during the 30 days before the reduction, or, if the Product has been offered for a shorter period, the lowest price since it was first offered.
  4. Information about Product characteristics, ingredients, method of use, precautions and volume is available on the Product page. The Customer should read it before purchase and use.
  5. Colours displayed on a screen may differ slightly from the actual colours due to display settings and parameters. This does not limit the Seller's liability for the Product's conformity with the Contract.

§ 5. Placing an Order and Entering into the Contract

  1. The Customer selects a Product, adds it to the cart, provides the information required to fulfil the order, selects delivery and payment, and then confirms the order using a button clearly indicating an obligation to pay.
  2. Before placing the order, the Customer sees a summary including the Products, their prices, delivery costs, the total amount payable and the selected payment method.
  3. After the order is placed, the Seller sends confirmation of receipt to the email address provided. The Contract is entered into when the Customer receives a message confirming that the order has been accepted for fulfilment.
  4. The Seller may contact the Customer if the information provided is incomplete, payment has not been completed, or fulfilment requires clarification.

§ 6. Payments

  1. Available payment methods are shown in the checkout each time. They may include payment card, BLIK, Przelewy24 and other methods made available by payment operators.
  2. Electronic payments are handled by external operators under their terms. The Seller does not receive full payment card details.
  3. If a payment is not authorised or completed, the order may remain unpaid or may be cancelled after the Customer is informed.
  4. The sales document is delivered electronically unless the law or an agreement with the Customer requires another form.

§ 7. Delivery

  1. Delivery is made to the address provided by the Customer within the countries served by the Store.
  2. Current delivery methods, costs and estimated delivery times are presented before the order is placed.
  3. For deliveries within Poland, the Store currently provides:
    • standard delivery: PLN 18.00,
    • free standard delivery for orders of at least PLN 150.00.
  4. The order processing time and estimated delivery time are calculated in accordance with the information shown on the Product page and in the checkout. If an order contains Products with different lead times, the longest lead time applies unless the parties agree otherwise.
  5. The risk of accidental loss of or damage to the Product passes to the Consumer when the Product is handed over to the Consumer, unless the Consumer independently selected a carrier that was not offered by the Seller.
  6. It is worth checking the condition of the parcel on receipt. Visible damage to the packaging does not deprive the Customer of the right to make a complaint.

§ 8. Right of Withdrawal

  1. A Consumer and an Entrepreneur entitled to consumer rights may withdraw from the Contract without giving a reason within 14 days from the date on which the Product comes into the possession of the entitled person or a third party designated by that person other than the carrier.
  2. To meet the deadline, it is sufficient to send the withdrawal statement before the deadline expires. The statement can be sent to kontakt@badnailz.com or by post to the Seller's address. The withdrawal form provided below may be used, but this is not mandatory.
  3. The Seller promptly confirms receipt of a withdrawal statement sent electronically.
  4. The Customer returns the Product without undue delay and no later than 14 days after informing the Seller of the withdrawal, to: BAD NAILZ / BAD BEAUTY sp. z o.o., ul. Wrocławska 33D, 55-095 Długołęka, Poland.
  5. The Customer bears the direct cost of returning the Product unless the Seller agrees to bear it or failed to inform the Customer of this obligation.
  6. The Seller refunds payments received, including the cost of the least expensive standard delivery method offered by the Store, no later than 14 days after receiving the withdrawal statement. The refund may be withheld until the Product is received or proof of return is provided, whichever occurs first.
  7. The refund is made using the same payment method used by the Customer unless the Customer expressly agrees to another method at no additional cost.
  8. The Customer is liable for any reduction in the value of the Product resulting from handling it beyond what is necessary to establish the nature, characteristics and functioning of the Product.
  9. The right of withdrawal does not apply in the cases specified by the Polish Consumer Rights Act, including in particular a Product supplied in sealed packaging that cannot be returned after opening for health protection or hygiene reasons — only where both of those conditions are met.

§ 9. Complaints and Product Conformity with the Contract

  1. The Seller is liable to a Consumer and an Entrepreneur entitled to consumer rights for a lack of conformity of the Product with the Contract that existed at the time of delivery and is disclosed within two years from that time, in accordance with the Polish Consumer Rights Act.
  2. A complaint can be submitted to kontakt@badnailz.com or by post and, where possible, should include the order number, a description of the problem, the date it was identified, the expected solution and contact details. A receipt or invoice is not the only acceptable proof of purchase.
  3. In the first instance, the Customer may request repair or replacement, subject to the exceptions provided by law. In the cases specified by law, the Customer may request a price reduction or withdraw from the Contract.
  4. The Seller responds to a Consumer complaint within 14 days of receiving it.
  5. The costs of repair or replacement, including shipping, transport, labour and materials, are borne by the Seller to the extent required by law.
  6. Complaints from Customers who are neither Consumers nor Entrepreneurs entitled to consumer rights are handled under the Polish Civil Code, subject to mandatory provisions of law.

§ 10. Reviews and Customer Content

  1. If the Store allows reviews to be published, the Seller informs Customers whether and how it verifies that a review comes from a person who used or purchased the Product.
  2. It is prohibited to publish unlawful content, content infringing third-party rights, content unrelated to the Product, advertising content or misleading content.
  3. The Seller may moderate content in accordance with the law and published review rules. The Seller does not publish fictitious reviews or commission their publication.

§ 11. Personal Data

The rules governing the processing of personal data and use of cookies are described in the Privacy Policy available in the Store.

§ 12. Final Provisions

  1. Polish law applies to the Contracts. The choice of law does not deprive a Consumer of protection granted by provisions that cannot be excluded by agreement and that would apply in the absence of that choice.
  2. A Consumer may use out-of-court complaint and redress procedures, including contacting the relevant provincial Trade Inspection authority, permanent consumer arbitration court, or municipal/district consumer ombudsman. Information is available at https://polubowne.uokik.gov.pl.
  3. A change to these Terms and Conditions does not affect orders placed before the change comes into force. Registered Customers will be informed in advance of changes concerning ongoing services.
  4. These Terms and Conditions are effective from 24 August 2026.
